Blake Lively alleged leaked nudes - x5 [ADDS]

You have a point, but there's no legal precedence for such a thing. If I claim I have a picture of you, but you deny it's you, then you are admitting that the copyright is mine. Therefore I can do anything I like with it. The way the law stands, something can't be embarrassing for you if it isn't you; libel is an exception, but this isn't libel.

To think up an example on the spot, I think that Blake Lively and Cate Blanchett look vaguely similar (obviously Lively is younger though). If Blanchett does a nude scene, but I mistakenly post it on my blog saying it's a Blake Lively nude scene, Blake Lively can't then deny that the scene is her, whilst simultaneously banning the scene from all blogs and forcing the film out of stores and cinemas everywhere, simply because it's 'embarrassing' that there's a similar looking actress nude in the film; she doesn't own the work and therefore can exert no rights over it simply because of a subjective, superficial facial similarity (or because some eejit like me on the internet claims they look similar). If these pics aren't Blake, then it's exactly the same, out there somewhere is a real girl who holds the real legal power. Perhaps I'm overthinking it, but Lively threatening legal action in this way is an unfounded threat, which is one thing that really bugs me.

I admit, there is some case for defamation where Blake's name is specifically attached to the pics. That said, Blake's rep said that they will sue anyone who has "published these photographs and any other outlets that republish them in any manner", note the "in ANY manner", in other words, they'll sue you regardless of whether when posting them you happen to claim they are Lively or not - they can't do that! The implication is that if the real girl posts these pics on her own website, stating that they are of herself, Blake Lively will sue her. What possible right does Lively have to sue a girl for posting pics of herself, who states they are of herself, on the internet?

Edit: Just as an addition to the above paragraph, the only way they could make such a bold claim is if they know who the owner of the pictures is, if you get my meaning.

Oh yeah I just finish watching TMZ and they talked about the pics for a "hot second" and it was during the credit and the end of the show. They didn't show any of the pics, but one the guys said he got a virus on his computer. He was trying to click on the pics and it "blew up" his computer. Everyone laughed it off. So they were taking all of this that seriously.
