    It's still a balcony on private property. I wouldn't exactly call it public view as she is well above ground level. Particularly as several shots are of her inside the dwelling. I don't want to argue the point as it's not for me to say, but the photographer only obtained the shots with equipment the was meant to see where normal vision could not.

    How is it different than having a drone go places and take video/pictures of people on their own property behind privacy fences or hedges? Anything is technically public view if you try hard enough to get the best angle.

    I'm not attempting to ruffle feathers as we have certainly seen worse. It's just something any of us would likely be upset with if we, or someone we loved, were spied on in such a manner.
