You’re talking about the production of a pornographic film. This would have been a sale of the video after the fact by one of the people in it. It was never stolen, Ray J claimed to have sold it to vivid. He’s changed his story recently, but for years he said he did it without her consent. Kim had to agree for it to be released, but she did sue to stop it, at first. That’s a matter of record. They settled, which probably included a large payday for her consent.

Point is, it doesn’t have to be a calculated thing. It may have been something she agreed to after the fact.

Production/distribution are bound to the same law in regards to performer release and documentation. Obviously this law only applies to American companies but Vivid was a legit company and there's no way they buy a product that doesn't come with signed releases from the performers along with proof of age. Traci Lords almost got a lot of people locked up ten years earlier over not having legit paperwork so it's something a huge company like Vivid wouldn't play around with.

Vivid was more than happy to play along with the storyline of a stolen tape so Kim could pretend to be an innocent victim but it's complete nonsense. I remember a few years back she tried to claim to be a victim of her Playboy shoot because she didn't really want to do it, as if there weren't negotiations and contracts signed for an exclusive photoshoot for them. Rumor at the time was she had input on final cut of the video and that sort of checks out when you watch the tape there aren't any "bad" shots of her and there's also nothing too graphic (the camera always seems to cut away before it starts looking like an actual porn). Also for someone who never imagined the video would be seen by anyone else, she chose the softest/darkest light possible to film in and yet still be visible on camera.
